Privacy Policy

This Privacy Policy explains how Cold Banana FZCO ("we", "us", "our") collects, uses, stores, shares, and protects personal data when you use the Preloved Uniform Dubai website and marketplace. Cold Banana FZCO is a Dubai free zone company (FZCO) and the owner of this platform. We operate from Dubai, United Arab Emirates.

We designed this policy to comply with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (the PDPL) and its executive regulations, and to reflect related UAE rules that apply to our marketplace, including consumer protection and VAT record-keeping. As a Dubai FZCO outside the DIFC and ADGM, we treat the federal PDPL as the applicable data protection law. The DIFC and ADGM data protection laws apply to companies established in those specific free zones.

1. Who is responsible for your data

Cold Banana FZCO is the data controller for personal data collected through this website. That means we decide why and how your information is processed. We operate the marketplace under the trading name Preloved Uniform Dubai.

We have not appointed a separate Data Protection Officer. Privacy requests should be sent to hello@preloved-uniform.com. If we later appoint a DPO as required under the PDPL, we will publish those details here.

2. The personal data we collect

Depending on how you use the marketplace, we may collect:

  • Identity and contact data: name, email, mobile number, WhatsApp number, and UAE address (emirate, area or community, building or street, apartment or villa).
  • Account data: login details, Google sign-in identifiers if you use Google, profile photo, and whether you choose to stay anonymous on listings.
  • Listing data: item photos, description, school, size, colour, condition, price, delivery options (collection, on-demand courier, next-day courier), and PTA contribution.
  • Transaction data: orders, payment references from Stripe, delivery or collection choice, courier booking references, and payout amounts for sellers and schools.
  • Communications: emails, WhatsApp messages you send us, and messages we help you start with another member to arrange collection.
  • Technical data: IP address, device and browser type, pages viewed, favourite school stored in your browser, and cookies needed for login, basket, and security.

We do not ask for Emirates ID, passport numbers, or bank card numbers on our forms. Card payments are handled by Stripe. Bank details for seller payouts are collected and stored by Stripe, not on our servers.

3. Children and school uniform photos

This marketplace is for parents and adult guardians in the UAE. You must be 18 or over to create an account. We do not knowingly create accounts for children.

Listings are about uniform items. Size and school can relate to a child. Please do not include a child's face or name in listing photos or descriptions. If we notice such content, we may edit or remove the listing.

4. Why we use your data (lawful processing)

Under the PDPL we process personal data only where we have a lawful reason:

  • To perform our contract with you: create your account, publish listings, take payment, notify buyers and sellers, arrange collection or courier delivery, and pay sellers and school PTAs.
  • To meet UAE legal obligations: keep VAT and accounting records, handle consumer complaints and refunds, and respond to lawful requests from UAE authorities.
  • For legitimate interests that do not override your rights: prevent fraud, keep the site secure, understand how the marketplace is used, and improve it.
  • With your consent: optional marketing, non-essential cookies, and Google sign-in. You can withdraw consent at any time without affecting processing that already took place.

5. Payment, couriers, and other parties we share data with

We do not sell personal data. We share it only where needed to run the service or where UAE law requires it:

  • Stripe: to take card payments, hold funds, and pay sellers and schools. Stripe processes payment data as an independent controller / processor under its own terms.
  • Courier partners: if a buyer chooses courier delivery, we share pickup and drop-off name, phone, and address so the courier can collect and deliver the item.
  • Google: if you sign in with Google, Google shares the email and name you allow.
  • Email and hosting providers: who store or send data on our instructions.
  • Other members: a buyer and seller on the same order may see each other's name, email, phone or WhatsApp number, and the area needed to arrange collection. Listings show first name (unless you are anonymous) and area/emirate, not your full building address.
  • Schools / PTAs: contribution amounts related to sales of that school's uniform, not your full browsing history.
  • UAE authorities: if required by law, a court, or a regulator including the UAE Data Office.

6. International transfers

Some processors (including Stripe and Google) may store or access data outside the UAE. Where we transfer personal data outside the UAE, we do so in line with the PDPL: either to a jurisdiction with an adequate level of protection as recognised under UAE rules, or with appropriate contractual and security safeguards.

7. How long we keep data

We keep account and listing data while your account is open. Order, payment, VAT, and dispute records are kept for the period required under UAE tax and commercial record rules (typically at least five years for VAT-related records), then deleted or anonymised unless we must keep them longer for a legal claim.

8. Security

We use HTTPS, access controls, and Stripe for payments. No website can guarantee absolute security. Please use a strong password and keep your login details private. If we become aware of a personal data breach that poses a risk, we will notify the UAE Data Office and affected users as required by the PDPL.

9. Your rights under the PDPL

Subject to the limits in the PDPL, you may:

  • Obtain information about how we process your data
  • Access a copy of your personal data
  • Request correction of inaccurate data
  • Request erasure where the PDPL allows it
  • Request restriction of, or object to, certain processing
  • Request transfer of your data (data portability) where technically feasible
  • Withdraw consent where processing is based on consent
  • Object to direct marketing
  • Lodge a complaint with the UAE Data Office, the federal supervisory authority for the PDPL

To exercise these rights, email hello@preloved-uniform.com from the address on your account and tell us what you need. We may need to verify your identity. We will respond within the timeframes required by UAE law. You can also update much of your profile yourself in My Account Details.

10. Consumer refunds and marketplace terms

Under UAE consumer protection rules, if an item is not as described you may request a refund within 14 days of collection or delivery. Second-hand uniform is sold as seen, based on the listing photos and stated condition. Platform service fees include UAE VAT where applicable. Collection is arranged between buyer and seller (usually on WhatsApp). Courier delivery is booked after the seller confirms the item is still available.

11. Cookies

We use essential cookies for login, your basket, security, and remembering your favourite school. Any analytics cookies are used only to understand site usage. See our Cookie Policy for details. You can control cookies in your browser; blocking essential cookies may stop sign-in and checkout from working.

12. Changes to this policy

We may update this policy when our services or UAE law change. The latest version will always be published on this page with an updated date.
